1. Acceptance of Terms
By accessing or using Lumicid ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of the Service
Lumicid is a creator-business platform that includes: (a) TikTok and Instagram performance monitoring with email alerts on significant metric drops; (b) automated transcription of public videos you submit; (c) competitor analytics on public profile metrics; and (d) Collably, a brand-deal outreach module that sends emails on your behalf via your connected Google account. Features may be added, modified, or removed over time.
3. User Accounts
You must create an account to use the Service. Authentication is provided via Zitadel; you are responsible for maintaining the confidentiality of your sign-in credentials and for all activities under your account. You must be at least 18 years of age and have the legal capacity to enter into binding contracts. You agree to provide accurate registration information and to keep it up to date.
4. Subscription and Billing
The Service is offered through paid subscription plans tiered by monitoring frequency (Daily, Basic, Standard, Frequent, Real-Time) and profile count. All payments are processed through Stripe. Subscriptions are billed monthly in advance and renew automatically until canceled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We offer a 14-day money-back guarantee for new subscribers as described in our Refund Policy.
5. Acceptable Use
You agree to use the Service only for lawful business and personal-analytics purposes and in compliance with all applicable laws and the Lumicid Acceptable Use Policy (lumicid.com/acceptable-use). The Service may be used to monitor: (a) profiles you own or are authorized to monitor; and (b) third-party ("competitor") public profiles for legitimate analytics, benchmarking, and market-research purposes. You must not use the Service to facilitate harassment, doxxing, defamation, or any unlawful activity targeting individuals or businesses, nor to circumvent platform-imposed access restrictions on private content. The Service does not access login-walled, private, or DM data on any monitored platform.
6. Customer Affirmations Regarding Monitored Profiles
By adding a profile to the Service, you affirm and warrant that: (a) the profile is publicly accessible; (b) you are using the resulting analytics for legitimate business or personal-research purposes; (c) you will not use the Service to harass, defame, or unlawfully target the profile owner; (d) you will respond promptly to any verified data-subject erasure or objection requests we forward to you; and (e) your use of the Service complies with the terms of service of the underlying platform (TikTok, Instagram, etc.) to the extent those terms apply to you. You are solely responsible for your monitoring decisions and for any consequences arising from your use of the resulting data.
7. Data and Privacy
We collect and process data as necessary to provide the Service. Our processing of public profile data is described in detail in our Privacy Policy (lumicid.com/privacy). The Service collects only publicly available data from monitored platforms — we do not access login-walled, private, or DM content.
8. Intellectual Property
The Service, including all software, content, design, branding, and trademarks, is owned by Lumicid or its licensors. "Lumicid" is a trademark of Lumicid. You retain ownership of any data you submit to the Service (e.g., URLs you submit for transcription). By submitting data you grant Lumicid a limited, non-exclusive license to process that data for the sole purpose of providing the Service to you.
9. Third-Party Services and Platforms
The Service integrates with and depends on third-party services including TikTok, Instagram, Stripe, Bright Data, Google (Gmail), Resend, and others (the full sub-processor list is in our Privacy Policy). We are not responsible for the availability, performance, terms, or content of those third-party services. Changes to third-party APIs, rate limits, or terms may affect the Service, and we may suspend or modify affected features without liability.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data fetched from third-party platforms will be accurate, complete, or timely. We expressly disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by applicable law.
11. Limitation of Liability
To the maximum extent permitted by law, Lumicid's total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid in subscription fees during the twelve months preceding the event giving rise to the claim. In no event shall Lumicid be liable for indirect, consequential, incidental, special, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, even if advised of the possibility of such damages.
12. Indemnification
You agree to defend, indemnify, and hold harmless Lumicid, its officers, employees, and agents from and against any and all claims, damages, costs, expenses (including reasonable attorneys' fees), and liabilities arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms or the Acceptable Use Policy; (c) your violation of any applicable law or regulation; (d) your violation of the terms of service of any monitored platform (TikTok, Instagram, or other third-party platform); (e) any claim by a data subject (including a competitor profile owner you added) regarding your use of their public data through the Service; and (f) your infringement of any third-party intellectual property or privacy right.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms, the Acceptable Use Policy, non-payment, suspected fraud, or other legitimate reasons. You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately, and we will delete or anonymize your personal data within 30 days as described in the Privacy Policy, subject to legal retention requirements.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of Istanbul, Türkiye. Nothing in this section limits any mandatory consumer protection or data protection rights you may have under the laws of your country of residence.
15. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Lumicid regarding the Service and supersede any prior agreements.
