Acceptable Use Policy
This Acceptable Use Policy ("AUP") describes how the Lumicid Service may and may not be used. It applies to every customer and every visitor and supplements the Lumicid Terms of Service. Violations may result in suspension or termination of your account.
Permitted Uses
You may use the Service for lawful business and personal-analytics purposes, including:
- Monitoring TikTok or Instagram profiles you own or are authorized to monitor.
- Tracking publicly visible competitor profiles for benchmarking, market research, and trend analysis.
- Generating transcripts from public videos for content analysis, accessibility, or repurposing.
- Sending brand-deal outreach emails to creators via Collably, using your own connected Google account.
- Aggregating and analyzing public engagement metrics for editorial, strategic, or commercial decision-making.
Prohibited Uses
You may not use the Service to do, or attempt to do, any of the following:
- Access, attempt to access, or store login-walled, private, or DM content from any platform.
- Circumvent, bypass, or attempt to defeat any access control, rate limit, or anti-fraud measure imposed by Lumicid or any monitored platform.
- Harass, threaten, defame, dox, or stalk any individual or business using data obtained through the Service.
- Build a profile of identifiable individuals (including minors) for the purpose of targeting them with abuse, discrimination, or coordinated inauthentic behavior.
- Use the Service for any illegal purpose, or in support of any illegal purpose, including violations of export-control or sanctions law.
- Use the Service to infringe intellectual property rights, including unauthorized redistribution of copyrighted videos, audio, or transcripts.
- Use the Service to send spam, phishing emails, or unsolicited bulk outreach. Collably outreach must comply with applicable email-marketing law (e.g., CAN-SPAM, GDPR consent or legitimate-interest framework, CASL).
- Use the Service to manipulate platform algorithms, generate fake engagement, or otherwise inflate or suppress metrics on any platform.
- Resell, sublicense, or repackage the Service, its data outputs, or its API responses without prior written authorization from Lumicid.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent expressly permitted by applicable law.
- Attempt to disrupt, overload, or attack the Service infrastructure (including DDoS, brute-force, or excessive scraping of our own endpoints).
- Submit content (URLs, transcripts, custom fields) that contains malware, exploits, or otherwise harmful payloads.
- Misrepresent your identity, your authorization to add a profile, or the lawful basis on which you use the Service.
Monitoring Third-Party Profiles
When you add a competitor or other third-party profile, you affirm that the profile is publicly accessible and that your monitoring is for legitimate business or personal-research purposes. You agree to forward any verified data-subject requests we receive (erasure, objection, access) regarding profiles you added, and to cooperate in fulfilling them. Lumicid reserves the right to remove a monitored profile from a customer's account upon a verified erasure or objection request from the profile owner.
Compliance with Monitored Platform Terms
TikTok, Instagram, and other platforms publish their own terms of service governing access to their data. Lumicid collects only public data and operates within the legal frameworks that protect public-data scraping (see Meta v. Bright Data, hiQ Labs v. LinkedIn). However, you are solely responsible for ensuring that your specific use of data obtained through the Service complies with the terms of service of any platform on which you have an account or to which those terms otherwise apply to you. Lumicid disclaims all liability arising from your platform-specific term obligations.
Enforcement
Lumicid may investigate suspected violations of this AUP and may, at our discretion: (a) issue a warning; (b) suspend or remove specific monitored profiles, transcripts, or outreach campaigns; (c) suspend access to the Service pending investigation; or (d) terminate the account. We may also report violations to law-enforcement authorities or affected platforms when required by law or when we believe in good faith that such reporting is necessary to prevent harm.
Reporting Abuse
If you believe a Lumicid customer is using the Service in violation of this AUP, including to harass, target, or stalk a profile, please contact [email protected]. If you are a profile owner who wishes to request removal of your data from the Service, please use our Data Subject Request form at lumicid.com/privacy/data-request.
Changes to This AUP
We may update this AUP from time to time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, sending an email notification to active customers.
